CLARITY Act Gets a Boost as Sheriffs Drop Opposition

The National Sheriffs’ Association (NSA) has dropped its opposition to the CLARITY Act, removing a law enforcement obstacle that had complicated efforts to build bipartisan support for the landmark U.S. crypto market structure bill. In a September 3 letter to Senate leaders, the NSA changed its position to neutral and said Congress should be allowed to continue negotiations on the regulatory framework. The move could help with Democratic votes, but disputes over government ethics and other provisions remain unresolved.

Sheriffs Step Aside Rather Than Endorse the Bill

The NSA’s September 3 letter provides a more nuanced signal than a straightforward endorsement.

Addressed to Senate Majority Leader John Thune and Minority Leader Chuck Schumer, the organization acknowledged that the CLARITY Act is attempting to regulate a market that has operated without sufficient oversight and credited Congress, the administration and other stakeholders for working through its legal and enforcement implications.

But the group stopped short of saying the legislation is ready for passage.

“Given the complexity of the legislation,” the NSA said, it was changing its position to neutral while lawmakers continue working through outstanding details. The association said the appropriate course was to “step back” and allow the legislative process to proceed.

That wording is significant. The NSA is no longer asking senators to oppose the bill, but it is also preserving room to challenge the final text.

Why the Shift Could Matter for Democratic Votes

The political importance of the decision comes from who had been listening to the sheriffs’ concerns.

According to Semafor, the NSA had spent months arguing that the legislation could make it harder for law enforcement agencies to prosecute illicit financial activity involving digital assets. That opposition created difficulties for Democrats such as Sen. Catherine Cortez Masto of Nevada, whose support is considered important to advancing the legislation.

The latest letter removes that particular source of pressure.

It does not guarantee that Cortez Masto or other undecided Democrats will support the bill. Instead, it changes the political calculation: senators concerned about appearing to weaken law enforcement no longer face an active opposition campaign from one of the country’s major sheriff organizations.

Other law enforcement groups have already gone further by supporting the legislation, making the NSA’s opposition increasingly notable before this week’s reversal.

The Letter Leaves One Important Question Unanswered

The NSA does not identify a specific legislative concession that caused it to change its position.

Its letter broadly praises work by Congress, the administration and stakeholders on the bill’s “legal, regulatory, and enforcement considerations,” but does not say that a particular amendment resolved its concerns.

That distinction is useful when assessing what has actually changed.

The development can be read as evidence that negotiations have reduced the NSA’s resistance enough for it to stop opposing the process. It cannot yet be treated as proof that disagreements over DeFi, non-custodial software or illicit-finance enforcement have been fully settled.

The final Senate language will provide a clearer answer.

CLARITY Act Still Faces a Bigger Political Fight

With the NSA stepping aside, attention shifts toward issues that cannot be solved simply through technical adjustments to crypto regulation.

Semafor identifies restrictions on the president’s ability to profit from digital assets as one of the higher remaining hurdles facing the legislation.

That debate introduces a different political problem.

Lawmakers negotiating the CLARITY Act are not only deciding how digital assets should be divided between federal regulators. Democrats have also sought safeguards addressing potential financial conflicts involving senior government officials and crypto businesses.

Those provisions could prove harder to negotiate because they involve political ethics rather than the mechanics of market oversight.

For the crypto industry, this means the NSA development improves the bill’s position without resolving the issue most capable of dividing lawmakers along partisan lines.

What the CLARITY Act Would Change

The broader objective of H.R. 3633 is to establish a federal market structure for digital assets and reduce uncertainty over which crypto activities fall under securities or commodities regulation.

That question has shaped years of disputes between crypto companies and U.S. regulators.

A statutory framework could give exchanges, token issuers and other market participants clearer rules for registration and oversight instead of leaving major classifications to enforcement actions and agency interpretation.

The NSA itself acknowledges the need for such a framework. Its letter describes the existing market as lacking sufficient regulatory oversight and calls a clearer system “much needed.”

That is arguably the most revealing part of its new position.

The association is no longer debating whether Washington should establish comprehensive crypto rules. Its reservations are now centered on the details of how those rules are written and enforced.

The Final Text Matters More Than the Headline

The immediate headline is favorable for the CLARITY Act: a prominent law enforcement organization that previously opposed the legislation is no longer trying to stop it.

The underlying signal is more restrained.

The NSA explicitly says important details remain under consideration, and its decision to become neutral should therefore be treated as permission for negotiations to continue rather than approval of the current framework.

For the next stage, the most useful indicators will be which Democratic senators publicly move toward supporting the bill and what compromises emerge around ethics and enforcement.

If the NSA’s reversal gives lawmakers additional political room to negotiate, it could improve the coalition behind the CLARITY Act. If those votes remain unmoved, the September 3 letter will have removed an obstacle without solving the bill’s larger problem.
